(Name)

Article 1 The Council will be named “Shimizu Port Typhoon & Tsunami Response Council” (hereafter, “Council”).

(Objective)

Article 2 The Council will deliberate and enact the necessary measures to prevent marine accidents due to typhoons (including
extremely developed ｄepressions hereafter)　and tsunamis at Shimizu port, and to secure the safety of ships.

(Membership)

Article 3 Membership will be comprised of administrative organs, corporate entities and other organizations related to Shimizu port,
as indicated in Appendix 1 “Shimizu Port Typhoon & Tsunami Response Council Roster.”

(Officers)

Article 4 The Council will have one President and one Vice-President.

      　 2 The Shimizu Maritime Safety Agency Director will serve as the Council President and the Shizuoka Prefecture Shimizu
　　　　　 Port Authority Director will serve as the Council Vice-President.

(Secretariat)

Article 5 The Secretariat of the Council will be placed at the Shimizu Maritime Safety Agency.

(Deliberations)
Article 6 Deliberations will take place in a general assembly and committees.
　   2 The Council’s general assembly will be comprised of all members, and the committees will be formed from among the members
　　　　 listed in Ａppendix 2, “Shimizu Port Typhoon & Tsunami Response Council Committee Roster.”

      3 A chairperson for the　general　assembly of the Council will be elected from its participating members.

      4 The committee chairpersons will be appointed by the President.

      5 The Council chairperson will prepare the minutes of the general assembly meeting, record the following items, and will designate
　　　　one or more present member to sign said minutes.

　　  （１）The objective of the meeting, date and place
　　　（２）Number of members and numbers of members present
　　　（３）Summary of the meeting’s progression and result

（Tasks of the Council general assembly）

Article 7 The President shall call the Council general assembly as necessary, and will proscribe investigation and deliberation of the
following items in order to attain the objective stated in Article 2.
　　　（１）　Measures against typhoons
　　 　　　a　Classification of port alert levels
　　　 　　b　Items to be enforced for each alert level
　　　　　 c　Other items necessary for the prevention of typhoon-related disasters
　　　（２）　Measures against tsunamis
　 　　　　a　Investigations of the effects of tsunami on the port
　　　　　 b　Formulation of ship response strategies
　　　　　 c　Other items necessary for the prevention of tsunami-related disasters

（Tasks of the Council committees）

Article 8 The President shall call the Council committees in the event that marine disasters or accidents are anticipated due to
typhoons or tsunamis in order to deliberate the following items and to deliberate the concrete strategies to be taken.
　　　（１） Measures against typhoons
　　 　　　a　Forecasting of the typhoon path and impact
　　　 　　b　Conditions of docked ships and hazardous cargo
　　　　　 c　Necessity of alert levels, timing of warning and termination
　　　　　 d　Method of evacuation
　　　　　 e　Other necessary measures
　　　（２） Measures against tsunamis.
　　　　　 a　Forecasting of tsunami impact
　　　 　　b　Conditions of docked ships and hazardous cargo
　　　　　 c　Necessity of alert levels, timing of warning and termination
　　　　　 d　Method of evacuation
　　　　　 e　Other necessary measures
　　　２　The President may substitute communication with committee members for committee meetings in emergency situations.

（Enactment of measures）

Article 9 The President shall submit recommendations to the Captain of the Port Shimizu based on the results of the deliberations stated
in the previous article.
　　　２　Members shall comply with notices and warnings announced by the　Captain of the Ｐort Shimizu and enact measures to
　　　　 prevent marine accidents from typhoons and tsunamis.
   　 （１）Measures against typhoons
　　　　　a. In the event that the　Captain of the Ｐort Shimizu announces a notice on a developed depression, necessary
　　　　　　 actions shall be taken accordingly.
　　　　　b. In the event that the　Captain of the Ｐort Shimizu announces warnings on typhoon, measures outlined in Appendix 3
　　　　　　 “Countermeasures against typhoon (including extremely developed depression)” shall be followed.
　 　（２） Measures on announcement of tsunami advisory or warning (tsunami or large-scale tsunami)
　　     In the event that tsunami advisory or warning (tsunami or large-scale tsunami) is announced, which is meant be an officia
　　　　 l announcement of the　Captain of the Ｐort Shimizu, measures outlined in Appendix 4-1 “Measures against tsunami” shall be
　　　　 followed.
　　　（３） Measures on announcement of a Tokai earthquake
　　　　　a. In the event that observed information regarding a Tokai Earthquake is announced, which is meant be an official notice of
　　　　 　　the　Captain of the Ｐort Shimizu, measures outlined in the implementation acts of “Observed information” category in
　　　　 　　Appendix 4-2 “Measures against a Tokai Earthquake” shall be followed.
　　　　　b. In the event that a caution is announced, which is meant be an official warning of the　Captain of the Ｐort Shimizu,
　　　　　　 measures outlined in the implementation acts of “Level 1 alert system” category in Appendix 4-2 “Measures against a
　　　　　　 Tokai Earthquake” shall be followed.
　　　　　c. In the event that prediction information or alert information is announced, which is meant be an official warning of the
　　　　　　 Captain of the Ｐort Shimizu, measures outlined in the implementation acts of “Level 2 alert system” category in
　　　　　　 Appendix 4-2 “Measures against a Tokai Earthquake” shall be followed.

（Maintaining report and communication system）

Article 10 The President, in order to ensure that members receive an accurate and timely notice and warnig of the　Captain of the
Port Shimizu, shall conduct reporting via telephone, FAX, or E-mail according to the measures outlined in Appendix 5, “Shimizu Port
Typhoon & Tsunami Response Council Communication System.”  In the event of an emergency, notification to ships may also take
place via VHF.

　　　２　Members shall inform to the president if their contact information changes.
　　　３　The President shall conduct an occasional trainings for communication.

（Supplementary rule）

Article 11 In addition to what has been proscribed in these by-laws, the President may, with members’ approval, proscribe additional
items regarding the management of the Council. 

　　　２　In the event that a revision to the by-laws becomes necessary, said revision shall be approved by a majority of present members
　　　　　at a general assembly meeting in which at least 2/3 of members including proxy, are present.

　Supplementary provision
　　１　By-laws are in effect from March 24, 2005.

The Shimizu Port Typhoon Response Council By-laws (December 1, 1981) are abolished.
　　２　Partial revision of by-laws are enforced from May 27, 2005.
　　３　Partial revision of by-laws are enforced from July 31, 2008.
　　４　Partial revision of by-laws are enforced from January 20, 2009.
　　５　Partial revision of by-laws are enforced from .Mａｙ 26, 2010
